Abstract: The Yearbook of European Law aims to promote the dissemination of ideas and provide a forum for legal discourse in the wider area of European law, covering the law of the European Union, the European Convention for the Protection of Human Rights, related aspects of international law and comparative laws of Europe. The first half of the book contains twelve essays on various topical legal issues. The first essay looks at the role of the various European courts, the Community Courts, the European Court of Justice and the Court of First Instance, which have played a fundamental role in the development of the rule of law and the system of judicial remedies in the EC. The second examines the role of the EU as an actor under international law, the third the interplay between the needs of the single market and the protection of intellectual property rights, using the case of Silhouette International Schmied GmbH & Co. KG v. Hartlauer Handelsgesellschaft GmbH [1998] as an illustration. Chapter four looks at the principles of social justice in European private law, and chapter five covers European common legal principles. Subsequent chapter titles are: Transparency and the emergence of a European administrative law; Legal certainty and revocation of administrative decisions: a comparative study of English, French and EC law; Television without frontiers; The European Central Bank: its system and its law; EMU: constitutional aspects and external representation; Antisuit injunctions for breach of a choice of forum agreement: a critical review of the English Approach; and In and out of the internal market: recent developments on the principle of free movement. Following these essays, there are surveys of: developments during 1998 - 1999 on environmental law, The European Convention on Human Rights, the Council of Europe and the institutional law of the European Union. The final part of the yearbook contains book reviews of various legal texts published during 1999. Also included are: a table of cases before the European Court of Justice and Court of the First Instance, a table of cases before national courts and authorities, lists of legislation (including national legislation), treaties and rules of procedure referred to in the text and a detailed index. The book should provide the reader with both background and a useful reference volume on recent developments in European law. |
