Who Said There is a ‘Right to Good Administration’? A Critical Analysis of Article 41 of the Charter of Fundamental Rights of the European Union

Abstract:

'Good administration' is a wide and flexible notion. Even though it concerns everybody's daily life, no precise definition can be found in law dictionaries. It also inspires soft law instruments such as the Civil Service Order in Council, the Citizen's Charter or the Civil Service Code. In everyone's mind, it is linked to 'maladministration' and to the model of New Public Management that is spreading all over Europe. But what is its precise meaning? There are very few answers to the question.
