Abstract: This article provides a report and detailed analysis of the landmark case of Ian Cook v. Environment Agency and May Gurney Ltd (17 May 2006). This is the first case in which the Environment Agency has ever been successfully prosecuted for a pollution offence. This article evaluates the future implications of this precedent case and discusses it in the context of other private prosecutions of environmental crimes. |
