The UK tobacco industry began legal action in the (UK) High Court on 18 October 2004, using European human rights law, to overturn the stringent restrictions on the advertising of cigarettes in shops. The industry is arguing that the rules on advertising are unlawful because they breach European Union law and article 10 of the Human Rights Act, designed to protect 'freedom of expression'.
