Implementation Appraisals

This briefing is one in a series of 'Implementation Appraisals' on the operation of existing EU legislation in practice. Each such briefing focuses on a specific EU law which is likely to be amended or reviewed, as foreseen in the European Commission's Annual Work Programme.

Implementation Appraisals aim to provide a succinct overview of material publicly available on the implementation, application and effectiveness of an EU law to date – drawing on available input from the EU institutions and external organisations. They are provided to assist parliamentary committees in their consideration of the new proposals, once tabled.

Further information

With infringement proceedings against some Member States, and pending assessment by the European Commission, an European Parliament own-initiative report reviewing the implementation of this directive was debated during the May 2018 (II) plenary session.Directive 2012/29/EU establishing minimum standards for the rights, support and protection of victims of crime was an instrument of harmonisation that set basic standards to be applied across the EU. It made important procedural provisions regarding, for instance, the right to be heard, to understand and be understood, and the right to receive information, make a complaint and access support services.

This study assessed the implementation of the directive and various aspects of its application: legal transposition measures at Member State level, the practical implementation of the directive on the ground, and the benefits it had provided for victims, as well as the challenges encountered.
