Abstract:

This work provides a comprehensive guide to the complexities of the new Brussels II Regulation. It includes detailed examination of jurisdictional matters, enforcement of access rights and the revised rules governing international child abduction.

The book is organised over eight chapters. The first deals with preliminary matters such as implementation, scope, interpretation, relationship with other international instruments and protective measures. Chapter two covers the transitional provisions. Central authorities are the feature of chapter three. The fourth chapter relates to divorce, legal separation and marriage annulment. Chapter five gives extensive coverage of parental responsibility. The new rules relating to international child abduction are the focus of chapter six. The seventh chapter deals with the recognition and enforcement of judgements. Chapter eight provides useful commentary on Brussels II.

A comprehensive set of Appendices contains all relevant source material including the full text of the new Regulation.

The work will interest scholars, students, practitioners and policy makers engaged in Family Law.

Nigel Lowe is Professor of Law at Cardiff University Law School.
