The French Conseil Constitutionnel since Early 2010: Its Growing Caseload and Its First Contact with the Court of Justice of the European Union

Abstract:

In the period under review, we have witnessed an explosion in the Conseil's case-law. This is not a result of the Senate elections in September 2011, the election of President Hollande in May 2012, the subsequent National Assembly elections in June 2012, or even any new constitutional amendments (of which there have been none). It is rather a direct consequence of the jurisdiction conferred on the Conseil in the field of 'priority preliminary rulings on the issue of constitutionality' (QPC).
