Abstract:

The aim of this book is to provide an impartial explanation and integral interpretation of the Regulation on Insolvency Proceedings (EC/1346/2000), including its most significant legal aspects and characteristics.

The work is organised in five parts. The first part addresses general issues and has chapters explaining the rule and its content, the cross-border model adopted by the Insolvency Regulation and the scope of operation of the Regulation. Part two explores the main insolvency proceedings and features chapters on international jurisdiction, the applicable law - lex fori concursus as general rule and exceptions thereto and applicable law - uniform rules. Part three examines territorial proceedings and offers analysis of the regime of territorial proceedings in general. Part four considers the general characteristics of the Insolvency Regulation’s system of recognition. Part five looks at the regime of co-ordination between parallel insolvency proceedings.

The work will interest practitioners, jurists and legal academics engaged in the field of insolvency.
