Article abstract:

This article investigates the operation of the European Employment Strategy (EES) considering its impact upon labour law. This exercise is carried out in the context of a specific case study: policy towards older workers within German law. Two processes are observed. First the tension between employment policy and social policy is examined in the light of the Framework Directive 2000/78 which introduces a principle of non-discrimination on grounds of age. Secondly, the divergence between national employment policy and the reporting thereof in the National Action Plans is examined.
