The Economic Cost of IPR Infringement in Spirits and Wine

EUIPO is the European Union Intellectual Property Office responsible for managing the EU trade mark and the registered Community design. It also works with the IP offices of the EU Member States and international partners to offer a similar registration experience for trade marks and designs across Europe and the world.

Until March 2016 it was called the Office for Harmonisation in the Internal Market (OHIM). This report presented the results of a sectorial study covering the production of spirits and wine, in the context of Intellectual Property Rights (IPR) infringements.

It is estimated that the legitimate industries loses approximately €1.3 billion of revenue annually due to the presence of counterfeit spirits and wine in the EU marketplace, corresponding of 3.3% of the sectors' sales.

An EPO/OHIM (2013) study revealed that both sectors are intensive in their use of trade marks and Geographical Indications and that designs are also used intensively in the spirits sector.
