However, standards can also be misused. The Commission has pursued several competition law cases aiming at avoiding such misuse, including the Samsung and Motorola cases in 2014. In the background of these cases are the so-called "smartphone patent wars", where holders of standard-essential patent (SEPs) sought to ban competitors' products from the market on the basis of their SEPs. The principles established in these two cases may apply even beyond the smartphone industry to other standards which are widely used.
