Summary: Staff Working Document (SWD) of the European Commission published on 14 December 2020, reporting on the implementation of Directive 2014/104/EU, also known as the Antitrust Damages Directive. Further information: Directive 2014/104/EU lays down rules allowing firms that are victims of cartel or antitrust violations to be compensated for damages. It also seeks to make leniency programmes more efficient. Article 20 of this Directive requires the European Commission to submit a report to the co-legislators on its application. It has been noted that there is insufficient experience on the application of the Directive at this point. For this reason, the report focuses on an overview of the implementation of the main rules of the Directive and of the various actions that the Commission has taken to ensure its effectiveness and to develop damages actions. The report also takes stock of key rulings from the Court of Justice of the European Union (CJEU) in the area of private enforcement. |
