Background and further information: The report reflects the European Commission's findings on the implementation and enforcement of the EU-US Privacy Shield framework in its first year of operation. Overall, it shows that the programme ensures an adequate level of data protection. Room for improvement was also detected. On this basis, the Commission drew up a list of recommendations on the functioning of the Shield that need to be improved by the US authorities. These recommendations were included in the Staff Working Document. The EU-US Privacy Shield decision was adopted on 12 July 2016, following a political agreement on a new framework for transatlantic exchanges of personal data for commercial purposes, reached in February 2016. The Shield reflects the requirements set out by the European Court of Justice in its ruling on 6 October 2015, which declared the old Safe Harbour framework invalid. The European Commission published on 18 October 2017 the first annual report on the functioning of the EU-U.S. Privacy Shield, the aim of which is to protect the personal data of anyone in the European Union transferred to companies in the United States for commercial purposes. |
