Summary:Regulation (EU) 2024/590 - adopted by the co-legislators on 7 February 2024 - concerning the substances that deplete the ozone layer. It repeals Regulation (EC) No 1005/2009. This is a text with EEA relevance. Further information:Ozone-depleting substances (ODS) are human-made chemicals that, after emission, frequently reach the upper atmosphere and damage the stratospheric ozone layer which protects the earth’s surface from dangerous UV radiation from the sun. This damage results in the so-called 'ozone hole' with significant adverse impacts on human health and the biosphere and which in turn entail high financial costs. Moreover, ODS are also strong greenhouse gases (GHG) with high global warming potentials. This Regulation lays down rules on the production, import, export, placing on the market, storage and subsequent supply of ozone-depleting substances, as well as on their use, recovery, recycling, reclamation and destruction, and on the reporting of information related to those substances and on the import, export, placing on the market, subsequent supply and use of products and equipment containing ozone-depleting substances or whose functioning relies upon those substances. It also repeals Regulation (EC) No 1005/2009 (also known as the ODS Regulation) which has been the main instrument addressing ODS in the European Union (EU). Its general objective was to prevent ODS emissions and safeguard compliance with the Montreal Protocol on Substances that Deplete the Ozone Layer (1987). A REFIT evaluation was carried by the European Commission, which concluded that the framework was generally fit for purpose, but also that it could be better aligned with the European Green Deal (2019). Moreover, its design could be slightly improved. The draft law was adopted by the European Commission on 5 April 2022 as part of a so-called Emissions and Pollutants Package. The plenary of the European Parliament endorsed a negotiating position on 30 March 2022. The Council of the European Union adopted its general approach on 5 April. A partial agreement between the co-legislators on a compromise text for this file was reached on 13 June, with the remaining elements of the proposal agreed upon on 5 October. This was formally endorsed by Parliament on 16 January 2024 and by the Council on 29 January. The Act was signed by the co-legislators on 7 February 2024 and published in the Official Journal on 20 February 2024. |
