Summary:Regulation (EU) 2023/2859 - adopted by the co-legislators on 13 December 2023 - establishing a European Single Access Point (ESAP) providing centralised access to publicly available information of relevance to financial services, capital markets and sustainability. Further information:This Regulation provides for the establishment and operation of a European Single Access Point (ESAP) by the European Securities and Markets Authorities (ESMA), in which it provides centralised electronic access to information relevant to financial services, capital markets and sustainable finance. The establishment of an ESAP was seen as a flagship action of the Capital Markets Union (CMU) Action Plan adopted in 2020. It seeks to provide EU-wide access to information activities and products of the various categories of entities that are required to disclose such information, in an efficient and non-discriminatory manner. Information is deemed essential for decision-making by providers of capital. The ESAP is part of the European financial data spaces presented in the European Commission's Digital Finance Strategy published in 2020. The draft was adopted by the European Commission on 25 November 2021 as part of a package of initiatives related to Capital Markets Union (CMU). The Council of the European Union adopted its general approach on the proposal on 29 June 2022. The plenary of the European Parliament endorsed a negotiating position for the proposal on 15 February 2023. An informal agreement between the co-legislators on a compromise text for this file was reached on 23 May. This was formally endorsed by Parliament on 9 November and by the Council on 27 November. The Act was signed by the co-legislators on 13 December 2023 and published in the Official Journal on 20 December 2023. |
