Summary:Regulation (EU) 2023/2844 - adopted by the co-legislators on 13 December 2023 - on the digitalisation of judicial cooperation and access to justice in cross-border civil, commercial and criminal matters, and amending certain acts in the field of judicial cooperation. Further information:This Regulation establishes a uniform legal framework for the use of electronic communication between competent authorities in judicial cooperation procedures in civil, commercial and criminal matters and for the use of electronic communication between natural or legal persons and competent authorities in judicial procedures in civil and commercial matters. It also lays down rules on the use of videoconferencing or other distance communication technology for purposes other than the taking of evidence under Regulation (EU) 2020/1783, on the application of electronic signatures and electronic seals, on the legal effects of electronic documents, and on the electronic payment of fees. These rules seek to improve access to justice and the efficiency and resilience of the communication flows inherent to the cooperation between judicial and other competent authorities in EU cross-border cases. They stem from an understanding that efficient cross-border judicial cooperation requires secure, reliable and time-efficient communication between courts and competent authorities. It should also be carried out in a way that does not create a disproportionate administrative burden and is resilient to force majeure circumstances. The draft law was adopted by the European Commission on 1 December 2021, as part of a legislative package focusing on the digitalisation of justice. It sought to address gaps within existing cooperation instruments as regards communication through digital means, including lack of secure and reliable digital communication or non‑recognition of electronic documents, signatures and seals. The Council of the European Union adopted its general approach to the proposed Regulation on 9 December 2022. The plenary of the European Parliament endorsed a negotiating position on 15 March 2023. An informal agreement between the co-legislators on a compromise text for this file was reached on 19 July. This was formally endorsed by Parliament on 23 November and by the Council on 8 December. The Act was signed by the co-legislators on 13 December 2023 and published in the Official Journal on 27 December 2023. |
