Summary:Directive (EU) 2024/825 - adopted by the co-legislators on 28 February 2024 - introducing amendments to Directive 2005/29/EC and 2011/83/EU as regards empowering consumers for the green transition through better protection against unfair practices and better information. This is a text with EEA relevance. Further information:Directive 2005/29/EC - also known as the Unfair Commercial Practices Directive (UCPD) - defines the unfair business-to-consumer practices that are prohibited in the European Union (EU). It applies to any act or omission directly related to the promotion, sale or supply of a product by a trader to consumers. Directive 2011/83/EU - also known as the Consumer Rights Directive - aims to approximate certain aspects of the laws, regulations and administrative provisions of the Member States concerning contracts concluded between consumers and traders. This Directive targets unfair commercial practices that mislead consumers away from sustainable consumption choices. It also ensures a better and more consistent application of EU consumer rules. It seeks to contribute to a circular, clean and green EU economy by enabling consumers to take informed purchasing decisions and therefore contribute to a more sustainable consumption. It is known as the ECGT Directive. The draft law was adopted by the European Commission on 30 March 2022, as part of a policy package addressing the sustainability of products. It is a deliverable of the New Consumer Agenda and of the Circular Economy Action Plan, in the framework of the European Green Deal. The Council of the European Union adopted a general approach to the text on 3 May 2023. The plenary of the European Parliament endorsed a negotiating position for this proposal on 11 May. An informal agreement between the co-legislators on a compromise text for this file was reached on 19 September. This was formally endorsed by Parliament on 17 January 2024 and by the Council on 20 February. The Act was signed by the co-legislators on 28 February 2024 and published in the Official Journal on 6 March 2024. |
