This proposal concerns the application of Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community ('the basic Regulation'), and in particular Article 9 and 14(1) thereof on imports of crystalline silicon photovoltaic modules and key components (i.e. cells) originating in or consigned from the People's Republic of China. The proposal is made in the context of the implementation of the basic Regulation and is the result of an investigation which was carried out in line with the substantive and procedural requirements laid out in the basic Regulation. The proposal for a Council Regulation is based on the definitive findings which have confirmed the existence of dumping causing injury, and the fact that the imposition of measures is not against the overall Union interest. Although the product scope has been amended at the definitive stage (by excluding wafers from the product scope) and the final duty rates have been slightly revised, the provisional findings were overall confirmed. The undertaking is foreseen to apply during the period of validity of provisional and definitive measures. It is therefore proposed that the Council adopts the attached proposal for a Regulation which should be published no later than 5 December 2013. |
