Summary:

The European Commission adopted on 29 June 2017 a proposal for a Council Decision on the position regarding compliance case ACCC/C/2008/32.

The proposal was endorsed by the Council of the European Union on 17 July.

The European Union (EU) signed the Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters ('the Aarhus Convention') in 1998.

The Aarhus Convention was the direct reason for the adoption of the Aarhus Regulation, whilst previous EU rules on access to documents helped shape the Convention. The findings of the Compliance Committee case (ACCC/C/2008/32) are problematic for the EU because the findings do not recognise the EU's special legal order.
