The Court of First Instance on 21 September 2005 approved the European Commission's decision to prohibit the proposed acquisition of Gàs de Portugal (GDP), the Portuguese gas incumbent, by Energias de Portugal (EDP), the Portuguese electricity incumbent, and the Italian energy company ENI. In December 2004, the Commission had prohibited the merger as it considered that the deal would significantly impede effective competition and deprive domestic and industrial customers from the benefits of competition. The Court's judgement confirmed that the European Commission had been right to block this merger in the absence of adequate remedies. |
