A Trade Mark proprietor may prevent the use of a comparison list presenting the product of a third party as an imitation of one of his products. The advantage gained by an advertiser through such a comparison list is achieved as the result of unfair competition and must, accordingly, be regarded as taking unfair advantage of the trade mark in question
