Abstract: Whereas classical political and legal doctrine is grounded on the separation of national political power and economic interests and thus ideally creates a system of balance of power where one branch watchdogs the other, the structures and course of actions of MNEs has created new challenges for national legislation and enforcement. This essay gives an insight into the disequilibrium between nationalized legal regulation and MNE conduct and analyzes limits and chances for change.
