Abstract:

This book aims to state the law as it is set out in the legislation and has been declared by the Court.

The work is organised over eight chapters. The first looks at the framework of the Court of Justice, exploring areas such as the constitution, jurisdiction and organisation of the Court. Chapter two considers the framework of the Court of First Instance and follows a similar format to that of the first chapter. Direct actions and associated proceedings are covered in chapter three, which deals with such areas as actions against Member States, annulment, failure to act, and other relevant elements. The fourth chapter relates to references from national courts, examining the importance, scope and operation of the reference procedure. Appeals from the Court of First Instance are dealt with in chapter five. The Rules of Procedure of the Court of Justice and of the Court of First Instance, which are set out in a single Protocol on the Statute of the Court of Justice annexed to the EU, EC and Euratom Treaties, are the subject of chapter six. The general principles of EU law, their application and sources are dealt with in chapter seven. The final chapter covers the principles of interpretation of EU law and the characteristics of EU law which have the principal influence on how it is interpreted.

The work will interest students, practitioners and judges engaged in European law and the workings of the European Court of Justice.
