Considers whether the European Court of Justice should fulfil the same role in promoting legal integration in criminal matters involving police and judicial co-operation as it does in respect of the Single Market. Discusses the court's role in market integration, the role of rights as a source of legitimacy and the nature of integration in criminal matters under the Treaty on the Functioning of the European Union. Reflects on why the court is not best placed to promote integration in the criminal field and why it should often act as a check to integration in such matters. |
