Publishers Abstract:
The last decade has seen a steady increase in the application by the European Union of restrictive measures either on an autonomous EU basis or as a way of implementing Resolutions of the UN Security Council. Sanctions have been used against governments of third countries, non-state entities or individuals and have emerged as a key instrument in the implementation of CFSP objectives. This has given rise to a fair amount of litigation, especially in the area of measures implementing UN terrorist sanctions. In Kadi, the Court of Justice established that it must, in accordance with the powers conferred on it by the Treaty, ensure the review, in principle the full review, of the lawfulness of all Community acts in the light of the fundamental rights forming an integral part of the general principles of Community law.
