Summary:Communication adopted by the European Commission on 29 September 2022, setting out guidance on the application of European Union (EU) competition law to collective agreements regarding the working conditions of solo self-employed persons. Further information:This guidelines set out the principles for assessing under Article 101 TFEU agreements between undertakings, decisions by associations of undertakings and concerted practices concluded as a result of collective negotiations between solo-employed persons and one or several undertakings, concerning the working conditions of solo-employed persons. The initiative was first launched by the European Commission, aiming to ensure the EU competition rules do not stand in the way of collection agreements that seek to improve the working conditions of self-employed people. An inception impact assessment was launched in January 2021, during which evidence was gathered. A public consultation was published in December 2021 inviting comments on the draft guidelines. The Communication was eventually adopted on 29 September 2022 and published in the Official Journal on the following day. |
