Abstract:

A theme which is central to this book is the interrelationship between fair trading and the functioning of the Internal Market, with particular emphasis placed upon the role of primary law.

The book is organised over five substantive chapters preceded by a comprehensive introduction. Chapter one explores fair trading in the EC Treaty - primary law - with particular focus on the case law on the free movement of goods and services. Chapter two presents analysis of fair trading by secondary law. The existence and the content of a principle of fair trading in the acquis communautaire is the subject of chapter three. The scope of the principle of fair trading is identified in chapter four, which complements the findings in chapter three regarding content. Chapter five examines the Unfair Commercial Practices Directive, comparing it with the Internal Market law principle of fair trading to assess the extent to which it would entail added value.

The book will interest scholars, students, researchers, policy makers and practitioners engaged in the fields of trade law, fair trade, European Trade Law and the Internal Market.

Malek Radeideh was formerly a researcher in the Department of European and Economic Law at the Rijksuniversiteit Groningen, The Netherlands, focussing on EC fair trading law. He now works in legal practice.
