"The example of the French iPhone exclusive deal shows the need for caution when assessing the competitive effects of exclusive agreements. The French Competition Authority’s decision, upheld by the Paris Court of Appeals, led to the suspension of the double exclusive deal with Orange. The Final Court of Appeals subsequently quashed the decision, while Apple and Orange had already committed themselves to ending this exclusive deal.In Section B, we present an economic and legal analysis of exclusive agreements in this type of market, then in Section C we study their legal treatment as implemented by the French national competition authorities."
