European Community law in the English Courts: This book, comprising revised papers from two legal conferences in 1996 in the UK and additional commissioned contributions from members of the judiciary and leading academics and practitioners, investigates from a practical perspective the increasingly significant impact of European Community law on English domestic law and procedure. It examines both the general principles of how EC law is given effect in the English courts (including the indirect effect of Directives in the application of national legislation, claims for damages against the State for breach of Community law, aspects of liability for the State and public bodies in English and Community law and judicial review and the role of the English Courts in European Community disputes), and also the impact that EC law has had on a number of particular key areas of English law such as competition, employment, intellectual property, criminallaw and tax law. The book shows that, while there have been some difficulties, the domestic legal community has responded well to the challenges posed by the Community legal system, which seems fundamentally different to its own.
