Abstract:

The first edition of this work was published in 1989, and in the 15 years since then there have been a number of far-reaching developments. First, the legislative developments at the European level - Maastricht and Amsterdam - which brought within the scope of the Community's competence the whole area of judicial cooperation in civil matters. Second, the growing body of case-law of the European Court of Justice on the Brussels Convention (70 cases since 1989) and the case-law of national courts. Third, the expansion of the EU and the number of jurisdictions subject to the Brussels-Lugano regime - now 22 and moving to 31. The work provides a description of the civil procedure and the judicial system of 21 of these jurisdictions - Gibraltar and nine of the ten new Member Sates are the exceptions.

Volume one consists of three parts. Part one addresses proceedings within England and Wales. Part two deals with the Brussels-Lugano regime and part three with UK legislation. All three parts deal with the law as at March 1 2004.

The second volume consists of part four of the overall work, which contains a description of the legal systems, the rules of jurisdiction and procedure of civil courts in each of the jurisdictions now subject to the Brussels-Lugano regime (with the exception of some colonies). Each jurisdiction is given a separate chapter.

The work will interest academics, legal practitioners and judges engaged in civil and commercial matters.
