Abstract:

This volume contains papers presented at the thirteenth annual conference of the European Air Law Association in Zurich, which was its first conference to be held outside the EU, and followed swiftly upon the corporate collapse of Swissair. The papers, eleven in all, are preceded by two welcome addresses from the President of the European Air Law Association and the Secretary General of the Federal Department of Environment Transport, Energy and Communications, Zurich.

The first paper addresses air navigation services, particularly Swiss Air Navigation Services in a Single European Sky. This is followed by a discussion of topical issues concerning airports, including hub congestion, slot allocation and noise legislation and management. The latter aspect also features in the third paper regarding the use of German airspace for the operation of Zurich airport. The Italian context of airports is the subject of the next paper which concentrates upon the noise problems. The liberalisation of air transport in the EU and the potential legal consequences are the focus of the fifth paper. The next three papers discuss aircraft accident investigation; the first features the UK and the role of the police and judicial authorities alongside the state's aviation investigation body; the next covers the Swiss experience and the third the German experience of accident and investigation. The ninth paper examines the fragmented and unstable nature of the airline industry and the rapid expansion of airline alliances and mergers. The question of airline ownership and control and the protective barriers to changes in that process are featured in the tenth paper. The final paper addresses the emerging policy of the European Commission in respect of airline alliances, protection and competition.

The work will interest lawyers and practitioners engaged in the European airline industry.
