Transparency Directive. The Commission has adopted an amendment to the Transparency Directive 80/723/CEE (Official Journal L195, 29.7.80, p35). The amendment aims at creating transparency in the accounts of companies which operate both in reserved and competitive sectors. Such companies would now have to introduce separate accounts for reserved and competitive activities respectively. Separate accounting will enable the Commission to ascertain 1) the possible extra cost of providing reserved services and the effective coverage of such cost by the State pursuant to Article 90(2) EC Treaty and 2) possible overspill of State funding into the competitive activity of the company providing reserved services, which overspill would constitute unlawful aid.
