European social dialogue is an involvement tool through which social partners take part
in decisions on socioeconomic policies and their application that has taken great importance during the
last years. However, its legal recognition at the highest regulatory level has not been modified since the 1992 Social Policy Agreement’s incorporation to the Treaty. The purpose of this essay consists in the analysis of the European Constitution project in order to find out whether it introduces relevant novelties to the recognition of social dialogue at European level as an essential element to move forward towards the construction of the European social model, through its inclusion as a European
Union objective, the recognition of social partners’ subjective rights and the setting-up of a certain
regulation of the dialogue mechanisms.
