Some people think that a European Constitution should be adopted for the future of a European Federal State, such as the USA. The Court of Justice has already characterised the EC's founding Treaties as a Constitutional Charter. The article examines this 'constitution', and asks whether or not it is comparable to the constitution of a state. If not, how could it be transofrmed into the consitution of a state? If this is not feasible, how would it be possible to improve the constitutional features of the EU's founding Treaties? |
