Book abstract:

This paper assesses whether such a thing as European Public Law exists and, if so, what form(s) it takes. At the heart of European Public Law appears to be a concern with the mutual influence and inter-penetration of EC Law, the ECHR and domestic laws. Are there similar developments occurring in all Member States concerning the influence of European Law and laws on domestic systems of law in Europe and vice versa? In particular, the paper examines what the influence of European laws has been on UK law and how the latter is changing under that influence. The conclusion is that such a phenomenon as European Public Law is emerging.
