Summary:Directive (EU) 2024/884 - adopted by the co-legislators on 13 March 2024 - introducing amendments to Directive 2012/19/EU on waste electrical and electronic equipment (WEEE). This is a text with EEA relevance. Further information:Directive 2012/19/EU provides a framework for dealing with waste electrical and electronic equipment. It repealed and replaced Directive 2002/96/EC, which was the original WEEE Directive. In January 2022, the Court of Justice of the European Union (CJEU) ruled in case C-181/20 the partial invalidity of the legal framework, notably parts of Article 13(1), by reason of non-justified retroactive effect. The judgment required follow-up through a targeted amendments to a number of articles of the WEEE Directive (12, 13, 14 and 15). It also addresses the impact of the Court’s judgment on other products falling under the ‘open scope’ set out in Article 2(1)(b) of the WEEE Directive. The draft law was adopted by the European Commission on 7 February 2023. The Council of the European Union adopted its general approach to the text on 16 June. The plenary of the European Parliament endorsed a negotiating position for the proposal on 9 November. An informal agreement between the co-legislators on a compromise text was reached on 21 November. This was formally endorsed by Parliament on 6 February 2024, and by the Council on 4 March. The Act was signed by the co-legislators on 13 March 2024 and published in the Official Journal on 19 March 2024. |
