Summary: This article examines the judgement of the case C-270/12 United Kingdom of Great Britain and Northern Ireland v European Parliament and Council of the European Union (Short Selling Ban). The United Kingdom (UK) brought an action for annulment of a specific provision of an EU regulation on short selling and certain aspects of credit default swaps. The Court dismissed the action and delivered an important ruling on the scope of permissible delegation powers within the context of harmonization of the internal market. |
