Summary:Decision (EU) 2023/145 - adopted by the co-legislators on 18 January 2023 - repealing Council Directive 89/629/EEC. Further information:This Decision repeals Council Directive 89/629/EEC. This Act provided that aeroplanes exceeding the relevant noise emission standards under that Directive could continue to operate, if they had already been entered in a national register of a Member State. However, a no-addition rule was also applied in this context. Directive 2006/93/EC introduced a complete phasing-out of all aeroplanes which did not meet the relevant noise emissions standards, including those covered by Council Directive 89/629/EEC, regardless of whether they had been registered or not. This led to a situation in which the aeroplanes concerned were no longer allowed to fly in the European Union (EU) skies and had to be removed from the Member States’ national registers. Consequently, Directive 89/629/EEC became obsolete. In April 2016, the main EU institutions signed an Interinstitutional Agreement on Better Law-Making committing to the updating and simplification of EU legislation. The repealing of this Council Directive 89/629/EEC is enacted in this framework. The draft Decision was tabled by the European Commission on 16 September 2022. The text was signed by the Council of the European Union and by the European Parliament on 18 January 2023. The Act was published in the Official Journal on 23 January 2023. |
