Summary: Framework Decision 2002/584/JHA - adopted by the Council of the European Union on 13 June 2002 - which is aimed at improving and simplifying judicial procedures to speed up the return of people from another Member State who have committed a serious crime. Further information: The European Arrest Warrant (EAW) effectively replaces the extradition system. It requires each national judicial authority to recognise and act on, with a minimum of formalities and within a set deadline, requests made by the judicial authority of another EU country. The aim of the EAW is to ensure that open borders and free movement in the EU are not exploited by those seeking to evade justice. An EAW issued by one EU country's judicial authority is valid in the entire territory of the EU. The mechanism is based on the principle of mutual recognition and therefore operates via direct contacts between judicial authorities. The proposal for this Framework Decision was tabled by the European Commission in September 2001. The European Parliament adopted an Opinion on the draft text in February 2002. It was adopted by the Council of the European Union on 13 June 2002 and published in the Official Journal on 18 July 2002. The Parliament adopted a further Resolution on the Framework Decision in October 2002. It has been in force since 1 January 2004 in all Member States. It has been amended by Council Framework Decision 2009/299/JHA. |
