Publishers Abstract:
The purpose of this article is to assess the current state of remedies in EU competition law. The rapid development of commitment decisions and the continuing focus on private enforcement have highlighted the question of remedies and their relationship with the substantive competition rules. Despite this fact, the treatment of remedies has only been subject to a comprehensive analysis to a limited extent. This article tests the limits of the current remedies available to competition authorities as well as private plaintiffs under Article 101 and 102 TFEU. Also, it discusses whether there are tensions between different forms of remedies and their respective functions which have to be sorted out.
