On Dec 14, 2004, in the so-called Prepared Mustard case, Federation des industries condimentaires de France and others v. Commission, the Court of First Instance rendered the first -- and so far only -- judgment on the correct interpretation and application of the Trade Barrier Regulation (TBR). The TBR is one of the European Union's common commercial policy instruments -- but one that has so far attracted surprisingly little attention. The TBR operates in a politically very sensitive area and the Regulation itself leaves open a number of important legal questions. Only a limited number of proceedings have been started under the TBR and until the Prepared Mustard case no case had been tried before the Community judiciary in Luxembourg. The importance of the Prepared Mustard case therefore lies in particular in the fact that it is the first to shed legal light on the TBR. Details of the case are presented.
