Introduction: On 17 September 2002, the Court of Justice issued its long-awaited judgment in the Concordia Bus Finland case. This case has important implications for the integration of 'secondary' considerations (i.e. non-purely economic, such as social or environmental) in public procurement. While the Court confirms that secondary criteria can be referred to at the award stage of atender process, it sets a number of conditions that must be fulfilled to ensure that no preference is given to national suppliers to the detriment of suppliers from other Member States. |
