The ECJ Order in Laurent Piau puts a provisional end to a lengthy saga -- yet another example of how FIFA has been subject to close scrutiny by the European Commission in the last years. Piau concerned the limits of FIFA's regulatory powers under Community law. More precisely, the Court assessed whether FIFA rules on players' agents are contrary to Article 81(1) EC and if so, whether they can be exempted on 'proper practice' grounds. Issued for the first time in 1994, and in force since Jan 1, 1996, the regulations on players' agents were challenged before the Commission in 1996 by Piau for an alleged breach of EC law. Despite the importance of the issues raised in the Piau case, little can be concluded from the CFI judgment and the ECJ Order. As far as the application of Article 82 EC is concerned, the scope of the notion of collective dominance remains as unclear as ever.
