In April 2004, the European Commission proposed a Framework Decision to establish minimum EU-wide safeguards for defendants in criminal cases, including access to legal advice, interpreting and translation services, and communication with consular authorities. Since then negotiations have continued with increasing opposition to the proposal, particularly from a small number of EU member states (including the UK) which have put forward an alternative political resolution. The Committee's report examines both current proposals and considers the reasons for objections to the legislative instrument (the Framework Decision) including potential problems arising under the European Convention on Human Rights. The Committee concludes that there is a need for EU action in relation to procedural rights but the current draft Framework Decision would add little value to existing protections under the ECHR.
