Abstract:

This is the eighth edition of a textbook on EC competition law and practice which has been widely used and respected for many years by practising lawyers, students and officials.

The book is organised over fourteen chapters. Following an introduction chapters two and three present analyses of Articles 81(1) and 81(3) respectively. Chapter four discusses dominant position, while chapter five looks at abusive exploitation. Chapter six explores state measures to protect firms from competition and chapter seven covers enforcement of Regulation 1/2003. Chapter eight begins the analysis of conduct that almost certainly infringes Article 81 and should be abrogated forthwith. Chapter nine analyses permissible types of agreements, such as bilateral exclusive dealing, technology licenses and other forms of collaboration such as specialisation agreements. Chapter ten looks at intellectual property rights and the free movement of goods, while chapter eleven examines the licensing of industrial and commercial property rights. Chapter twelve deals with merger control, and chapter thirteen dicusses joint ventures. Chapter fourteen is by way of conclusion and offers more general comments, some of which may be controversial.

The work will continue to be of interest to students, scholars, researchers and practitioners engaged in European competition law.
