An assessment of the compatibility of UEFA’s home grown player rule with article 45 TFEU

Publishers Abstract:
Presents the findings of a European Commission study into whether UEFA's 'home grown player rule' is compatible with the free movement of workers under the Treaty on the Functioning of the European Union art.45. Reviews the aims of the rule, the nature of the restriction it imposes and its potential to be indirectly discriminatory. Discusses the study's conclusions on: (1) whether the rule falls within the sporting exception, is justified by imperative requirements in the general interest, and passes the suitability and necessity tests; and (2) how its restrictive impact may be reduced.
