Summary:Directive (EU) 2024/1785 - adopted by the co-legislators on 24 April 2024 - introducing amendments to Directive 2010/75/EU on industrial emissions (integrated pollution prevention and control) and Council Directive 1999/31/EC on the landfill of waste. This is a text with EEA relevance. Further information:Directive 2010/75/EU - also known as the Industrial Emissions Directive (IED) - regulates the environmental impacts of the European Union's (EU) large-scale, high-pollution-risk industrial installations and livestock farms in an integrated manner, on a sector-by-sector basis. It covers all relevant pollutants potentially emitted by agro-industrial installations that affect human health and the environment. An evaluation carried out in 2020 concluded that the IED was generally effective in preventing and controlling pollution into air, water and soil from industrial activities, and in promoting the use of best available techniques. However, it also identified areas for improvement, in light of new challenges. It showed the Directive was not being implemented consistently across Member States with different levels of ambition preventing the instrument from fully delivering on its objectives. In order to address those challenges, the European Commission committed to revised measures in its European Green Deal. This Directive revises the existing legislative framework. Further large-scale intensive livestock farms are brought into its scope, as well as mining activities and large-scale manufacturing of batteries. It seeks to make the issuance of permitting more efficient and less burdensome, for instance by introducing an obligation for member states to establish an electronic permit system (e-permit) by 2035. Member Sates are also to establish effective, proportionate and dissuasive penalties in case of non-compliance with the Directive. The draft law was adopted by the European Commission on 5 April 2022. The Council of the European Union adopted its general approach to the proposal on 16 March 2023. The plenary of the European Parliament endorsed a negotiating position on 11 July. An informal agreement between the co-legislators on a compromise text for this file was reached on 28 November. This was formally endorsed by the Parliament on 12 March 2024 and by the Council on 12 April. The Act was signed by the co-legislators on 24 April 2024 and published in the Official Journal on 15 July 2024. |
