Summary:Recommendation (EU) 2023/2425 adopted by the European Commission on 20 October 2023, concerning the coordination of responses to incidents arising from the dissemination of illegal content, ahead of the full entry into application of Regulation (EU) 2022/2065 - also known as the Digital Services Act (DSA). Further information:Russia's invasion of Ukraine and the war between Israel and Hamas have contributed to a period of great instability on the global stage. Violence and war increasingly reverberate online across the European Union (EU) as a result of the wide reach of social media, which has led to to an increase in illegal and harmful content being disseminated, including coordinated actions to spread disinformation and misinformation through the EU. Regulation (EU) 2022/2065 - also known as the Digital Services Act (DSA) - laid down rules aimed at securing the EU's online information environment. It requires effective response to the dissemination of illegal content online and threats to civic discourse, elections and public security. It only applies in full from February 2024, but it is already applies to those designated very large online platforms and very large online search engines by the European Commission in April 2023. However, the effective monitoring and enforcement of the Regulation requires the assistance of and active cooperation with Member State national authorities. This Recommendation encourages Member States to respond in a coordinated and consistent manner to incidents, in particular arising from the dissemination of illegal content, posing a clear risk of intimidating groups of population and destabilising political and social structures in the EU or parts thereof, including those which risk leading to a serious threat to public security or public health in the EU or in significant parts of it, vis-à-vis designated very large online platforms and very large online search engines pursuant to Regulation (EU) 2022/2065, until it enters fully into force on 17 February 2023. The Recommendation was adopted by the European Commission on 20 October 2023 and published in the Official Journal on 26 October 2023. |
