Summary:Regulation (EU) 2023/1321 - adopted by the co-legislators on 14 June 2023 - introducing amendments to Regulation (EU) 2020/2170 as regards the application of European Union's tariff rate quotas (TRQs) and other import quotas to certain steel products transferred to Northern Ireland (NI). Further information:In accordance with the Withdrawal Agreement signed by the European Union (EU) and the United Kingdom (UK), and in particular the Protocol on Ireland/Northern Ireland, certain acts as defined in Regulation (EU) No 952/2013 applies to and in the UK in respect of NI. Considering the risks posed to the proper functioning of the EU's single market and the integrity of the Common Commercial Policy, the co-legislators adopted Regulation (EU) 2020/2170 which provides in substance that goods imported from outside the EI are eligible for treatment pursuant to EU import TRQs or other import quotas only if they are released for free circulation in the EU’s customs territory. However, whilst bilateral arrangements between the EU and the UK under the Protocol do not give rise to rights and obligations for any other third countries, hey do give rise to specific rights and obligations for the UK. The existing framework does not make it possible for UK originating goods to make use of the relating EU TRQs when transferred from Great Britain (GB) to NI. This Regulation amends the existing legislative framework to allow certain steel products originating in the UK and subject to EU safeguard measures be eligible for treatment pursuant to EU TRQs also if they are released for free circulation in Northern Ireland. The draft law was adopted by the European Commission on 27 February 2023. It followed up on a political agreement announced in February 2023 - the so-called Windsor Framework - whereby the two sides agreed a comprehensive set of joint solutions to ensure legal clarity, predictability and prosperity of communities in Northern Ireland, whilst also protecting the integrity of both the EU and UK internal markets. The plenary of the European Parliament adopted the proposal on 9 May, followed by the Council of the European Union on 30 May. The Act was signed by the co-legislators on 14 June 2023 and published in the Official Journal on 30 June 2023. |
