Summary:Regulation (EU) 2023/2418 - adopted by the co-legislators on 18 October 2023 - establishing an instrument for the reinforcement of the European defence industry through common procurement (EDIRPA). Further information:The European Union's geopolitical context changed dramatically in light of Russia's invasion of Ukraine. The return of territorial conflict and high-intensity warfare in Europe required EU Member States to rethink their defence plans. In March 2022, the EU leaders committed to bolster European defence capabilities as a consequence of Russia's decision to attack Ukraine. The European Commission later published a Joint Communication on Defence Investment Gaps Analysis and Way Forward. It provided insights on three main types of gaps: a financial gap, an industrial one, and a capability gap. The document also suggested that Member States should act collaboratively as they proceeded to fill the defence gaps and replenish stockpiles. Without cooperation and coordination, increase national investments into defence risked deepening fragmentation of the European defence sector. This Regulation establishes a short-term instrument for the reinforcement of the European Union's (EU) defence industry through common procurement, for the period from October 2023 until December 2025. A partial reimbursement from the EU budget is available to Member States where joint purchases involve a consortia of at least three countries. The instrument's budget is €300 million. EDIRPA also sets out conditions to make sure that the EU's defence industry benefits from the instrument. The draft law proposing a common procurement procedure through a dedicated Short Term Instrument establishing the European Defence industry Reinforcement through Common Procurement Act (EDIRPA) was adopted by the European Commission on 19 July 2022. The Council of the European Union adopted its general approach on 1 December. The plenary of the European Parliament endorsed a negotiating position on 10 May 2023. An informal agreement between the co-legislators on a compromise text for this file was reached on 27 June. This was formally endorsed by the Parliament on 12 September and by the Council on 9 October. The Act was signed by the co-legislators on 18 October 2023 and published in the Official Journal on 26 October 2023. |
